Wasama Terms of Service
For www.wasama.co.uk (Shopify)
1. Who We Are
Wasama UK is a trading name of Wasama Ltd, a company registered in England and Wales under company number 11678729, whose registered office is at 512 Streetsbrook Road, Solihull, B91 1RH ("Wasama", "we", "us", "our"). Our VAT registration number is GB322495802.
2. About These Terms
These Terms of Service govern purchases made through www.wasama.co.uk. By placing an order with us, you agree to be bound by these Terms. They apply only to orders placed directly through our website — purchases made through Amazon or Etsy are governed by those marketplaces' own terms and policies, not this document.
3. Eligibility
• You must be at least 18 years old, or have the consent of a parent or guardian, to place an order.
• By placing an order, you confirm the details you provide are accurate and that you have the legal capacity to enter into a contract with us.
4. Orders, Pricing and Payment
• All orders are subject to product availability and our acceptance. We may decline or cancel an order at our discretion (for example, in cases of pricing errors, suspected fraud, or stock unavailability), in which case we will notify you and refund any payment taken.
• Prices are shown in GBP and include VAT where applicable. We reserve the right to correct pricing errors and to change prices for future orders; this does not affect orders already confirmed.
• Payment is taken at checkout via the payment methods offered by our Shopify checkout. A contract is formed once we send you an order confirmation email, not before.
5. Shipping and Delivery
Orders are shipped in line with our Shipping Policy [link]. Delivery timescales given at checkout and in our Shipping Policy are estimates, not guaranteed dates. Risk in the goods passes to you on delivery; legal ownership passes once we have received payment in full.
6. Your Right to Cancel, Returns and Refunds
As a consumer, you have a legal right to cancel your order within 14 days of delivery under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, in addition to any goodwill returns policy we offer. Full details, including how to cancel, what is refunded, and timescales, are set out in our Return & Refund Policy [link], which forms part of these Terms.
Certain items are excluded from the right to cancel once made or personalised for you (see our Return & Refund Policy for the current list). This does not affect your rights in relation to faulty or misdescribed goods under the Consumer Rights Act 2015.
7. Faulty or Misdescribed Goods
Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 in respect of goods that are faulty, not as described, or not fit for purpose, including your short-term right to reject goods within 30 days of delivery. See our Return & Refund Policy for how to report a problem.
8. Intellectual Property
All content on www.wasama.co.uk — including text, product photography, logos, and designs — belongs to Wasama or its licensors and is protected by copyright, trade mark and other intellectual property laws. You may not copy, reproduce, or reuse this content without our prior written permission.
9. Acceptable Use
When using our website, you agree not to:
• use the site for any fraudulent or unlawful purpose;
• attempt to interfere with the security or normal operation of the site;
• infringe the intellectual property or privacy rights of Wasama or any third party.
10. Our Liability to You
• We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your statutory rights in relation to the goods, or for any other liability that cannot lawfully be excluded or limited.
• Subject to the paragraph above, our liability for losses you suffer arising from your order is limited to the amount you paid for the relevant product, and we are not liable for indirect or consequential losses that were not reasonably foreseeable to both parties at the time you placed your order.
11. Privacy
We process your personal information in accordance with our Privacy Policy [link]. By using our website and placing an order, you acknowledge how your data will be used as set out there.
12. Complaints and Dispute Resolution
If you are unhappy with our service, please contact us first at info@wasama.co.uk so we can try to resolve it directly. If we are unable to resolve a dispute, you may also be able to refer it to an approved Alternative Dispute Resolution (ADR) provider; we will confirm at the time whether we participate in a specific ADR scheme.
13. Governing Law
These Terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with these Terms is subject to the non-exclusive jurisdiction of the courts of England and Wales — meaning you may also be able to bring proceedings in your local courts if you are a consumer resident elsewhere in the UK or EU.
14. Changes to These Terms
We may update these Terms from time to time. The version that applied when you placed your order will govern that order; changes will apply to orders placed after the updated Terms are posted.
